(Stillwater) — A Ponca City man has avoided a jury trial in Payne County District Court on March 16 by pleading guilty to indecent exposure at the Wilshire Inn in Cushing.
Mark Pensoneau, 27, who was arrested by Cushing Police Sgt. Chuck Claxton last summer, remains in the Payne County Jail pending his April 23 sentencing before Associate District Judge Stephen Kistler.
Pensoneau pleaded guilty on Feb. 26 to exposing his genitals to a Texas man, his 11-year-old son, and two of the boy’s friends at the motel on July 11, 2009, court records show.
Three Cushing police officers had been sent to the Wilshire Inn at about 6 p.m. on a report of an intoxicated man causing a disturbance with customers in the pool area, Claxton wrote in an affidavit.
A Texas man said that he was standing in the pool area with his 11-year-old son and two of his son’s friends and that Pensoneau had been acting strange and appeared intoxicated, the affidavit said.
He said that when he complained to management about Pensoneau, the Wilshire Inn management helped escort Pensoneau to his room, the affidavit said.
The Texas man said that about 15 minutes later, Pensoneau opened his door at the motel, stood naked in the doorway of his room, yelled “hey,” and then shook his penis before turning around and walking back into his room, the affidavit said.
When police saw Pensoneau, he had slurred speech, was unsteady on his feet, and did not answer when asked what he had been drinking, the affidavit said. A nearly empty vodka bottle was in his room, which appeared to have vomit on the floor, the affidavit said.
After he was told that several witnesses saw him standing in his open doorway without any clothes, Pensoneau said, “It was not me — I want to talk to these people,” Claxton’s affidavit said.
During the booking process at the Cushing city jail, Pensoneau said that he had a piercing — which he was asked to remove, the affidavit said.
Pensoneau then put his hands down his pants and made a motion as if he were fondling himself, the affidavit said.
Indecent exposure is a felony punishable by as much as a 10-year prison term and a $20,000 fine, according to the charge filed by Payne County Assistant District Attorney Kathy Thomas.
