(Stillwater, Okla.) — A Cushing man admitted in court Friday that he possessed marijuana within 1,000 feet of a park and school that had been mailed in a small package to his residence from California.
Kenneth W. Jackson, 49, remains free on $2,000 bail pending his sentencing on July 15 before Payne County Associate District Judge Stephen Kistler.
Audelin M. Ryks, 52, who lived with Jackson at the house in the 1100 block of E. Moses Street, remains free on $2,000 bail pending a June 6 court appearance.
Cushing Police Detective Adam Harp had obtained a search warrant at 9:45 a.m. Nov. 1, 2010, for the couple’s home to search for drugs — including a small U.S. priority-mail package sent from San Jose, California, that smelled of marijuana and was addressed to “Uncle Kenny,” court records show.
A Cushing U.S. Postal Service employee placed in the couple’s mailbox the package that was later found lying open on the floor when Cushing Deputy Police Chief Tully Folden saw it shortly before 2 p.m. that day, his affidavit alleged.
When the couple was asked where the contents of the U.S. priority-mail pacakage were, “Jackson said it is right here, as he stood up,” Folden wrote in an affidavit.
“I then observed a package wrapped in white tissue paper lying on the couch,” Folden wrote in an affidavit.
“Ryks said, ‘He was not expecting anything, but said it smelled like marijuana.’ Jackson said that same thing. When asked how they knew what marijuana smells like, both Jackson and Ryks said they smoke marijuana,” the affidavit alleged.
A green leafy substance that field-tested as marijuana was contained in a single baggy in another baggy, the affidavit alleged.
“Jackson said that he had numerous items related to drug paraphernalia. Jackson then opened a small wooden box, which was lying on the coffee table, which contained a glass smoking pipe with burnt residue,” that also field-tested as marijuana, the affidavit alleged.
The couple’s residence, from which various items including pills were seized, was located 835 feet from the Park Street Park and 913 feet from Wilson School, the affidavit said.
